Offer Terms
Services and equipment must be ordered, installed, and activated between and including February 1. 2008 and July 31, 2008. This offer is limited to new, first-time residential DISH Network® subscribers who: (1) reside in the continental United States, Hawaii, Alaska, or Puerto Rico and (2) provide DISH Network with their Social Security Number or last four (4) digits of their Social Security Number. Only one participant is allowed per household. This offer may not be combined with any other offer. Local and state sales taxes and other fees and charges may apply. Social Security Numbers are used to obtain credit scores and will not be released to third parties except for verification and collection purposes or if requested by governmental authorities.
Equipment Purchase
You agree to purchase, install and activate either a two-receiver DISH Network DISH 311 or dual tuner DISH Network DISH 322 satellite TV system for $199 or a one-receiver DISH Network DISH 311 satellite TV system for $149 and subscribe to Qualifying Programming as described below. Eligible equipment includes DISH 311 or equivalent. You may upgrade to a model 510, 522, 625, ViP211TM, 411, ViP222TM, ViP612 DVRTM, ViP722 DVRTM, or ViP622 DVRTM for an additional non-refundable charge.
Qualifying Programming
A programming package of DishFAMILY (currently $19.99/mo. or $24.99 with local network channels where available), America's Top 100 (currently $32.99/mo. or $37.99/mo. with local network channels where available), America's Top 200 (currently $44.99/mo. or $49.99/mo. with local network channels where available), America's Top 250 (currently $54.99/mo. or $59.99/mo.
with local network channels where available), DishLATINO (currently $27.99/mo. or
$32.99/mo. with local network channels where available), DishLATINO Plus (currently $32.99/mo.
or $37.99/mo. with local network channels where available), DishLATINO Dos (currently
$39.99/mo. or $44.99/mo. with local network channels where available), DISH Latino Max
(currently $49.99/mo. or $54.99/mo. with local network channels where available), dishHD (currently $29.99/mo. or $34.99/mo. with local network channels where available), a Chinese-language programming package (currently $29.99/mo. or $34.99/mo. with local channels where available), a Russian-language programming package at a current price of no less than $32.99/mo. or $37.99/mo. with local channels where available, a Greek-language programming package at a current price of no less than $32.99/mo. or $37.99/mo. with local channels where available, a Polish-language programming package at a current price of no less than $39.99/mo. or $44.99/mo. with local channels where available, an Arabic-language programming package at a current price of no less than $44.99/mo. or $49.99/mo. with local channels where available, a Portuguese-language programming package at a current price of no less than $44.99/mo. or $49.99/mo. with local channels where available, or a Hindi-language programming package at a current price of no less than $54.99/mo. or $59.99/mo. with local channels where available (Arabic, Chinese, Greek, Hindi, Polish, Portuguese, and Russian-language programming packages at the minimum prices listed above are each referred to in this Agreement as a "Minimum International Programming Package" (collectively, "Qualifying Programming")is required as your minimum subscription level at all times.
Equipment Credit
A monthly equipment credit of $5.00 will be applied to your DISH Network account for up to 40 consecutive months after system activation for the two-receiver or dual-tuner DISH Network satellite TV system, or a monthly equipment credit of $5.00 will be applied to your DISH Network account for up to 30 consecutive months after system activation for the one-receiver DISH Network satellite TV system. The monthly equipment credit amount will be determined by the number of receivers (1 or 2) activated at the time of initial installation. Additional receivers added after initial installation will not change number of monthly equipment credits. If you activate with two receivers but later deactivate the second receiver, you will forfeit any remaining monthly equipment credits past 30 . You will forfeit any remaining monthly equipment credits if you downgrade your programming below Qualifying Programming or your service is disconnected for any reason. Maximum number of monthly equipment credits is 40.
Equipment and Installation
For installations performed in the continental United States or Hawaii, standard professional installation of up to two (2) receivers to up to two (2) televisions, a DISH 500 antenna (or a DISH 1000 where required for local channel packages or DishHD programming packages, or a DISH 500 antenna where required for local channel packages or International programming, or a 24-inch or larger DISH 300 antenna for residents of Hawaii), and mounting hardware is included. For installations performed in Alaska or Puerto Rico (i) standard professional installation of up to two (2) receivers to up to two (2) televisions is included and (ii) dish antenna hardware and installation are sold separately. In certain installations, additional equipment may be required and additional fees may apply. For installations performed for residents of Hawaii who purchase America 's Top 250, DishLATINO, DishLATINO Dos, DishLATINO Max, or any programming package which includes high definition programming, additional equipment will be required and additional fees may apply. For installations performed for residents in the continental United States who purchase International programming broadcast from a wing satellite (61.5 or 148) location, an additional purchase of a second antenna will be required and additional fees may apply.
Service Fees
Additional Outlet Programming Access Fee: a non-refundable additional outlet programming access fee of $7 per month (in the case of a model ViP211, 411, ViP612 DVR tuner and tuner number one in a model ViP722 DVR, ViP622 DVR or ViP222 receiver) or $5 per month (in the case of all other tuners) will be charged to your account for each tuner activated beyond the first. (For the purpose of determining the amount of this fee and whether it applies to a particular tuner, tuner number one shall be deemed to be activated prior to tuner number two in a dual tuner receiver and model ViP211, 411, ViP612 DVR, ViP722 DVR, ViP622 DVR, and ViP222 tuners shall be deemed to be activated prior to all other tuners). One $5 per month additional outlet programming access fee will be waived on a monthly basis for each dual-tuner receiver (models 322, 522, 625, ViP222, ViP622 DVR, and ViP722 DVR) activated. This fee will be waived on a monthly basis for each such receiver that DISH Network confirms has been continuously connected to your same land-based phone line and/or (solely in the case of a model ViP622 DVR or ViP722 DVR) continuously connected to your same broadband home network resulting in the functionality of the applicable receiver's Internet-based features. DISH Network's confirmation process(es) shall be the sole method(s) utilized to determine if your additional outlet programming access fee(s) will be waived; DISH Network DVR Service Fee: a non-refundable $5.98 per month DISH Network DVR service fee will be charged to your account for each model 510, 522, 625, ViP612 DVR, ViP722 DVR, or ViP622 DVR receiver activated. This fee will be waived if you subscribe to either America's "Everything" Pak; HD Enabling Fee: A $7.00 per month HD enabling fee will be charged to your account if any model 411, ViP211, ViP222, ViP612 DVR, ViP722 DVR, or ViP622 DVR receiver is activated. This fee will be waived on a monthly basis if you subscribe to dishHD Essential, DishLATINO Max HD Essential, dishHD or DishHD Package (only available for residents of Alaska and Hawaii). A $10.00 change of service fee for each adult programming change and a $5.00 change of service fee for any other programming change will be charged to your DISH Network account.
Warranty
Standard one-year warranty includes no-cost repair/replacement of manufacturer defects during the first 90 days of such warranty period. For the remainder of the one-year warranty period, a $14.95 shipping charge applies to replacement of warranty-covered equipment by mail and a $99 in-home warranty trip service charge applies if such replacement requires "in-home" service. Programming
Local channels are only available by satellite to customers who reside in specified local designated market areas (each, a "DMA"). Channels may vary by market. Each DMA is subject to change without notice. To find out whether you are eligible for certain local channels, you may call us at 1-888-284-7116 or revisit our website at www.dishnetwork.com. ESPN and ESPN2 programming are subject to change and blackout restrictions and are licensed separately for residential and commercial use. Sporting events telecast locally may also be included in ESPN packages. FOX Sports Networks programming is subject to blackout restrictions and licensed for residential use only. Regional sports networks are not available in all areas. Payments for programming are not deposits and are non-refundable.
Other Terms and Conditions
DISH Network shall determine eligibility for participation in its sole discretion and reserves the right to deny eligibility for any reason. The Free-For-All Promotion is also subject to the terms and conditions of the Residential Customer Agreement, which is available in your receiver User's Guide or at the link below entitled "Residential Agreement."
WE RESERVE THE RIGHT TO CHANGE PRICES, PACKAGES, AND PROGRAMMING AT ANY TIME, INCLUDING WITHOUT LIMITATION, DURING ANY TERM COMMITMENT PERIOD TO WHICH YOU HAVE AGREED.
